GlaxoSmithKline (“GSK”) is suing Pfizer and BioNTech in Delaware federal court, alleging infringement of GSK’s patents on mRNA technology in their covid injections.

As reported by Reuters, GSK alleges in the lawsuit filed on Thursday that Pfizer-BioNTech’s Comirnaty injections infringe on GSK’s mRNA vaccine patents developed more than a decade before Pfizer began marketing its “vaccine.”

A Pfizer spokesperson said in a statement that the company is “confident in our [intellectual property] IP position around Comirnaty.”

A GSK spokesperson said the company believes its patents “provided the foundational technology used in Pfizer and BioNTech’s covid-19 mRNA vaccines.”

London-based GSK asked the court for an unspecified amount of monetary damages from Pfizer and BioNTech that includes an ongoing patent licencing fee.
